At Nathan Gabrielle we deal with a wide variety of commercial litigation matters.
The disputes that we are called upon to deal with are as varied as our client base. For example, at the time that this web page was drafted our Litigation Department were handling cases including:-

• Suing a US based permanent health insurer for breach of contract
• Defending a claim that had been brought against a racehorse trainer by a building company who were seeking to recover payment for the construction of a horseracing "gallop"
• Pursuing a professional negligence claim against a firm of Solicitors
• Defending a company that had been accused of breaching design rights of a French company
• Bringing an action against one of the Partners in a Partnership who refuses to agree to assets being sold

It may seem odd to say this, but most of our Commercial Litigation clients when they come to us are miserable individuals. This is usually because they are unhappy that they are either going to have to sue someone or are being sued themselves. In the Commercial Litigation Department our aim is to make them happy!

Commercial Litigation usually involves reacting to a situation quite quickly. Sometimes we may only have a few hours warning that a client wants to issue proceedings against an ex-employee to obtain a restraining order (formerly known as an Injunction) to stop an ex-employee who has for example run off with a client list or confidential information.

We have very good working relationships with the Barrister's Chambers. If an urgent conference is required then usually a telephone conference can be arranged or alternatively a litigator from Nathan Gabrielle and a Barrister, if required, are happy to travel to our client's premises.The key to successful commercial litigation is team work.

This means that we at Nathan Gabrielle, the Barrister, the expert (if required) and the client have to work together. If this necessitates attending meetings on site, out of hours or at the drop of a hat, then we always strive to achieve this.
We aim to explain matters clearly to our clients at the outset and to give them a reasonable idea of their prospects of success, either pursuing or defending a claim.
